Colonized bodies: sexual violence as a war strategy in Colombia

Synopsis

Sexual violence in the context of the armed conflict is one of the bloodiest war practices, and it has not been alien to the internal conflict in Colombia. As a result, thousands of victims of this form of violence - especially women, people with non-hegemonic gender identities, children and adolescents - have suffered serious violations of fundamental rights. Since it is a manifestation of such reprehensible violence, this work suggests that the legal system has observed a movement to broaden the catalog of the rights of victims of sexual violence in the internal armed conflict, in order to respond to the needs of sensitization and sanction against the phenomenon.

Thus, the present work questions what the impact of such extension of rights is, from the model of truth, justice and whole reparation, and from two complementary analysis frameworks: i) the paradigm of restorative justice and the new victimology; and ii) the normative analysis of Law 1719 of 2014, which regulates this specific form of violence, and contextualizes the victims’ guarantees. This book is inserted in the current situation of the country, derived from transitional justice and post-conflict processes; it affects awareness, knowledge of the victims’ rights, and the sanctioning mechanisms for those who incur or have incurred sexual violence in development of the hostilities of the armed conflict.
